  • What are forms to be filled for AOS from B1/B2

    Hi all,
    I am applying for for AOS husband who came here on a B1/B2 visa. We are filling up forms but beofre we post what are the problems we are facing thought wd clarify with you whther these are the forms we have to fill or not :

    I-485 ( foreign citizen )- $1010 ( including $930 plus a biometrics fee of $80 )
    I-130 ( for usc ) - $355.
    I-765 (foreign citizen)- Included in the cost of I-485
    I-131 (trvel doc for foreign citizen ) - Included in the cost of I-485
    I-864 or I-864EZ ( for usc ) - no fee
    g-325a ( one for usc and one for foreign citizen)- no fee
    I-693 (medical exam for foreign citizen, filled out by an USCIS civil surgeon) What ever the Civil Surgeon Charges...

    Right ?? and whom shd the cheques be written to ??

    All helps wd be highly appreciated.

    You are pretty smart!

    You got all the information right. The checks must be written to US Department of Homeland Security and all forms sent at the same time to the Chicago Lockbox.

    Read the instructions for the forms, all the info you need is there.

        Family based green card

        Hello there,

        I just got married almost two months ago and my husband is an American Citizen. I came in the US with a tourist visa that has expired a couple months ago...I've also overstayed for a little over 1 1/2 year. I have my visa, passport and my I-94 (although at this moment are all expired pretty much).

        Now, would I still be able to adjust my status with all that going on?

        In addition I have a 16 and a 10 year old sons, could they be my dependents if I file?

          Yes, you can file, but you should not leave the USA until the GC is approved (not even with an approved Advance Parole) otherwise you will be banned from entering the USA for 10 years.

            Thanks for your reply! My sons are here in the US with me and my husband. Another question that I have is about the financial support, I'm a ESL teacher but I'm currently not working because I'm here with a tourist visa. We are currently living/being supported by my husband's college grant and some income that I have (one rented apartment) from my country. Now, my hubby is a full time student at Duke University and he actual income is based on his grant. We have the last award letter showing a grant award of $69.000 for the school year of 2008/2009...Would this be enough to sponsor us...or should I try to bring in some bank documents from my country to prove that I also still have some income there??? The only thing is if we need to bring info from my country everything needs to be translated, notarized and so on, and it would be so much easier if we could just go as his dependents at the moment...

            I will certainly be looking for a job as a teachar as soon as I get my work permit and social security...DO YOU THINK IT WOULD BE A GOOD IDEA TO WRITE A LETTER to the immigration, such as a personal declaration of my intentions in staying in this country...my only concern at the moment is if they think we would become "a burden" or "public charge" as they say...we are currently with a tight budget because of my husband's medical school, and for the fact that I can't work yet...but as soon as we organize this situation we will definitely be making more money very soon...

              Stage I'm at so far...questions about documents...

              Now, we have decided to apply for me and my older son, as my younger son will be returning to Brazil soon. So far these are the applications I have already done. (by the way I'm the one doing it, since my hubby has no time whatsoever and I'm home all day at the moment...)

              All these applications are ready, but when I started gathering the documents it asks for, I got a little confused...since I'm filling it all together, do I need to repeat documents such as passport copies, marriage certificates, for each application as they ask for, or should I send one copy of each document necessary and make it as one whole package...sorry, even my question here sounds confusing...

              How many photos from each person to each application???


              I-485 ( Myself )
              I-485 (foreign dependent child 16)
              I-130 ( From my husband petitioning to myself)
              I-130 (From my husband petitioning to my son)
              I-765 (foreign citizen)
              I-765 (foreign dependent child 16)
              I-864 or I-864EZ ( from my husband )

              I-693 (medical exam myself and my son) done...

              BASICALLY, I GUESS MY FINAL QUESTIONS ARE:

              *WHICH DOCUMENT GOES WITH EACH APPLICATION???
              *HOW MANY PHOTOS PER APPLICATION??? *
              *CAN I BASE THE FINANCIAL SUPPORT ONLY ON HIS SCHOOL GRANT???
              *WE LIVE IN NORTH CAROLINA, I FIGURED THAT WE NEED TO MAIL IT ALL TO THE CHICAGO, IL ADDRESS RIGHT??

                Teaching in the K-12 schools in the US requires credentialing. Some states allow teachers who have been teaching in there home country to sit for exams and receive an alternative certification. This certification may or may not be honored by other states; others do not. Getting a teaching job above K-12 does not have that problem but are far fewer.

                If you intend to teach, research the requirements and begin studying.
