domestic abuse! vawa application

hey all,
i'm new to this forum and i just wanted to know if anyone is familiar with the vawa apllications for victims of domestic abuse, especially mental/ emotional abuse? How hard r these apllications to file/ suceed? is it just a waste of time? how do abused victims get help?

You need a LOT of evidence... these are hard to prove but not impossible... You WILL need an experienced lawyer... and like I said, the key word is EVIDENCE... reports, statements, affidavits, pictures, recordings, etc... that show the abuse...

In this case "mental/emotional" abuse is very hard to prove... and you must show WHY you remaining in the USA is necessary somewhat... like if you have children who are living here as USC, etc.

I need help I am married to a usc he petition me in sept 2013. I am being emotionally abuse been force to do abortion he says he didn't want a child he said my bastard son is enough smh my son is not biological his I can't forgive myself of the abortion and everyday he makes me cry calling me nAme I had my interview feb27 2014 he says he aint coming he dont feel like it I call and rescheduled my question is I want to file for i360 do u knw if I can convert my I 130 to i360 I have all my documents to prove a bonafide marriage but pictures because we really was in love I just dont know wat I did wrong I want to get out of this marriage but he is the one supporting me right nw...could I get any help

Take this a step at a time

1. Do you have any evidence of the mistreatment you have experienced? Women's shelter report? Counselling report? Hospital reports? Police reports?
2. Is your interview for Adjustment of Status?
3. Or are you outside the U.S. awaiting approval for an I-130 and interview or an I-130?

Noooo I have no evidence I have my form of the abortion he force me to do and It was mandatory to speak with a social worker but he made it clear to behave like I am not married and to say positive things the lady probably saw that I am not an let me filled out a depression form she said u r in depression and she gave me a list of ppl to call I didn't I was super scared I dont make no report of anything he said if I ever say anything he will deport me before I could blink ......and Yes it was an adjusent of status interview and no I am in the united states..

You need to go to the Adjustment of Status interview, with or without your husband. If you do not show up at all, your application will be denied, followed by a Removal Order. If you do show up, without your husband, one of two things will happen: they will approve you, anyway, if you have significant proof of time together, or the reviewer will tell you he has no choice but to deny your Adjustment procedure and then provide you with "self-petitioning" information.
