I got married in march 2002 in USA. My wife is a canadian landed immigrant and entered USA in Feb 2002. As a canadian landed immigrant, she did not require a visa to enter USA, so there is no I-94 either. I had my I-140 approved last month and now I want to file for I-485 (employment based, professional with Bachelors degree) for both of us. My wife did not go back to canada after entering USA in feb 2002.
What should I say about her status on INS forms, also, will it have any negative effect on my case if I include her. I assume that she will not be out fof status for six months and if we file for employment authorization, we may receive it in 90 days and it will still be less then six months for her.
Please advise.
