Overstayed by 1 month and now leaving USA

Hi all,
I dont know if this is the right forum to post or not.I came here on a B1/b2 visa and after a stay of almost 90 days married my fiance.Now my visa expired on June 15th.So I am overstaying.Now I have to go back due to some reasons and may not return back.
Can someone tell me what happens ??
a)As i know one has to submit his I-94 to the flight staff .......do they question about the overstay ??

b)Do the Indian port of entry question and create trouble , as the visa expiration date in stamped on my passport.

You'll have ...

... problems when you return to the United States, they don't care much when you're leaving the country.

Relax, leave the country and don't count on returning.

So you got married and what is going to happen to your spouse?

You can always return, but get yourself a lawyer first before you do anything when you plan of coming back so they won't hit you with than 10 year ban.

Need Help Please!!!

I am entered in US with the Visa I 94 in June. We have got married on 08-02-2008. On 08-08 we have sent I 485 and I 130 the applications to Chicago I have a return air ticket at the 09-05-2008 .Need I fly back to Germany or can I wait till I receive answer even if my Visa I 94 has gone off?

I really would be very pleased if anyone could help me!!!
