  • Need your suggestions please

    Sirs and Madam,
    I really need your suggestions.

My I-140 is approved as an Extraordinary Ability without job offer (self-petitioned) through a lawyer.

    My question is:

    1. When filing I-485 by myself, which Employer letter do I need to prepare: a Letter stating my future job offer after getting GC? or a Letter just stating my present job, title and salary?

    2. How dangerous is it to my case if there is a contradict in job duty or field description between petition letter for I-140 and employer letter for I-485? (because lawyer never gave me copy of I-140 petition letter, and it is IMMPOSSIBLE to get it from him.

    3. If my I-485 is denied due to question 2, do I have chance to start whole procedure again (from new I-140)?

I would very much appreciate your guidance.

    don't worry

Get an employment verification letter from your current employer. Have them be sure to state that this is a permanent, full-time position.

Don't worry about too much conflict between the I-140 and the I-485 job title. Your I-140, in the job title field, should probably just say "alien of exceptional ability." You yourself should have provided most of the evidence and details that went into your case. Getting a copy of the petition from the lawyer won't help or hurt much.

So, if you are a nuclear scientist (for instance), and you're working as a research scientist in a nuclear facility, there should be no problem.

However, if you're a nuclear scientist and are currently working as a veterinarian for an animal hospital, there's likely to be a few questions. You get the idea...

At the I-485 stage, the INS gives you a chance to explain anything that doesn't seem right to them. This is called a "request for evidence." They will send you a letter before anything is denied. This will be your chance to explain your employment.

      Thank you for your suggestion

      Hi, Suomilainen.

I really appreciate your response. Thank you very very much.

I raised this question here is because my lawyer delays my case for almost one year. My I-140 was approved last May. Then after paid him full fee including I-485, I have been ignored till now. I could not reach him by phone, fax, email. and even certified letters were returned. So I decide to do next step by myself.

Your response makes me so confident.
      Thank you again
