Question on I-485/I-360

I filed I-360 based on VAWA ( violence against women act) back in early 2005 and I got this case approved then my lawyer filed I-485 together, however since my ex was permanent resident and not a citizen, the immigration officer didn't grant me the visa because according to visa bulletin, I needed to wait another 3-4 years and i have been waiting since the interview in 2006. My lawyer said that this case is based on "employment" because I'm categorized as a special immigrant but THEY say that my case is still under "FAMILY based immigration"...I'm really confused and tired of waiting! Does anyone know the answer??
