  • I-485, I-130, & I-765

    Hi everyone,

Please help me with this. I just filed my marriage-based adjustment of status application (I-485) concurrently with I-130 (petition for alien relative and I-765(employment authorization). I submitted the application last August 13, 2008 with the filing fee total in 2 money orders of $1705.00 ($930 for I-485, $355 for I-130, $340 for I-765 and $80 Biometrics fee). I was surprised that they sent back the application and the receipt notices say: The application/petition ... is being returned to you for the following reason = the check amount is incorrect or has not been provided. Also on the I-765 receipt notice, it says: If you have filed this form(I-765) concurrently with the form I-485, and your form was rejected as well, you can re-file this form concurrently with your form I-485 to adjust your status as Permanent Resident, and you are only required to pay the application fee for Form I-485 (i.e. no fee is required to file for employment authorization on Form I-765). I am confused! I don't understand why the USCIS rejected the application when as far as I know, I followed the new fee schedule.

Before I resubmit the application, can somebody please help me clarify things first to avoid the application from getting sent back again? As far as I know, I have the right amount. Is it because I submitted not 3 separate checks for each form? Did I pay more than the required amount? Probably I should have paid only $1365 ($930 for I-485, $80 Biometrics fee and $355 for I-130)? As stated in the I-765 notice, I don't have to pay the fee for I-765 because I am concurrently filing it with I-485. Am I correct in my interpretations. Please be kind to assist me on this matter. I have to make sure that everything is ok before I resubmit my application.

Thank you in advance for your kind assistance. God Bless.

    Sincerely,

    Randy

Send one check for $1,010 (i-485 and biometrics) and one check for $355 (for the i-130).

That is all. The fee for AP (i-131) and EAD (i-765) are included.
