    Hi Guys;

    I just called CSC center and confirmed with ISO that My dad's fingerprints were rejected. We already went twice to Newark office for his FP but somehow it's not coming clear. I am still waiting for the INS letter.

    Can I go ahead and submit the Police Clearance certificate for last 5 years ?

    My father is 67 years old and according to them because of the age his FP is not clear.

    I just called FBI and they told me to contact Local Police Station and send the FP to West Virginia for Name records and they will take 3-4 weeks + $18 Fee.

    I am not sure what will be the next RFE from INS for 3rd times FP ? Can I just go ahead and get the record from INS and submit to INS rather than waiting the letter from INS ?

    Can he travel thru AP ?

    I am still waiting for my dad's I-130 and I-485 approval.

    My Timeline

    This is for both my parents -
    SENT 130, 485, 131, 765 on 2/27/2008
    Received Receipt Notices - 03/5/2008
    Completed FP on 3/27/2008
    Received RFE for Birth Certificate on 3/19/2008
    Sent RFE response on 3/31/2008
    RFE response received by USCIS on 4/3/2008
    LUD, Message and Email from USCIS for 485 - RFE response received and case resumed - 04/06/2008
    AP and EAD LUD - 06/2/2008
    AP and EAD Approved Email - 6/20/2008
    I-130 & I-485 Transfer to CSC: 6/26/2008
    I-130 still Pending - LUD 8/21/08 (Father)
    I-485 still Pending : LUD 8/18/08 (Father)

    I was in the same situation for my father.
    You will need a Police Clearance certificate from your local police staion in the city you live. The usually take a day or two.
    In addition to that you will require a Police Clearance Certificate from India as well. The USCIS requires 5years of records.
    I submitted my fathers Police certificates and he got his green card approval within 2 weeks of submission.

      How long did it take to get the INS Notice ? Can I just go ahead and get the certificates and submit to INS prior to RFE ?

      Can you please tell me your timeline ?

        It took them a couple of weeks to send the RFE. They also had told me over the phone about the fingerprint rejection and said the officer will issue a RFE.
        Once the RFE was issued I received the RFE within 10 days.
        I suggest that you should start preparing to get the Police Certificate from India as that may take a while to get.
        Also someone told me that Indian Embassy and Consulates also issue police clearance certificates for India.

          Can I start preparing the documents from India ? Is that ok if the date on the certificate is older than RFE ?

          Can I submit the papers before the RFE ?

          How long do you think I should wait for RFE ?

            If you want you can start preparing from India. It does not matter if it is dated a little earlier than the RFE.

            Do not submit the documents without the RFE letter attached. This way it will go in the right place.

            If you have filed thru an Attorney than the RFE will go to the attonney otherwise it should come directly to you within 10 days.

            If you do not receive in 10 days than you should call the USCIS.

              Hi Manish13,

              Did you have to get the police certificate from India? My wife is in a similar situation, her finger prints are unidentifiable. She has been in the US for only 1 year. Was it sufficient to get only 1 year policer certificate, or does she need to get the remaining 4 years certificate from India?

              Any help is appreciated,
