  • How far back on W-2 and payslips

    Does anybody know if there is a law or INS directive that demands for W-2 and Paystubs for an I-485, If so, can you please point me to the source.

    I am trying to file it myself as a derivative status issue, and I can't find out why I should need either. I am on an H-1 myself BTW.

    As a derivative? If the derivative is on H1, 2 years worth of w-2s should be sufficient. There are no memos or directives on this issue. It is purely based on lawyers' practice/habit which is in turn based on INS generating RFE on some cases submitted without W-2s.
    If you have them submit them. If you don't , you cannot anyway.

      We were asked for it

      In order to approve our I485 we were asked for the past three years W-2's(required) and tax returns (optional)and latest pay stubs from the employer.
