  • HELP I'm getting different answers from USCIS

    I need to know if I can count my husband's income on the avidavid of support? He is the intended immigrant and I am the sponsor. He just started working this year. I've been told by USCIS that I could not use his income because he doesn't have taxes for the last three year...well yeah duh! But I got a letter back from them telling me that he needs to fill out the I-864A but it states that the person filling that out has to be an american citizen. But I am sure that they already realize this so not sure why they would sent that. Anyway it says on the instructions for the I-864A that I can count him as a memeber of the household and use his income. Do they really expect for him to have been here for over 3 years?? I could ask my parents but my mother is about to have chemo for breast cancer and I don't really want to bother them. Thanks for your help


    EDIT: honestly don't know what that matters but they gave him a work authorization card when we applyed for the I485
