  • Adjustment of status

    Hi
I am a little over two months in the States and I am working on filling my Adjustment Of Status forms, I cant afford a lawyer so I am filling them myself and it is quite confusing.
me and my wife are married almost for two years and living at her fathers house
my question is how can I know what forms do I need to fill in?
I know I need the I-485 and I-765 and also the G-325A, but with the other forms how do I know if I need the medical exam, and what kind of police clearance do I need to provide?
do I need to send the affidavit of support form together with the I-485? or I send it later?
I will be really grateful for any help.
    Cheers

What visa did you use to enter the country?

You may want to reconsider Adjusting your Status in the USA.

You entered using a visitor visa, less than 90 days ago, you have been married to an US citizen. What did you tell the officer at the airport when you entered the USA, regarding the purpose of your visit?

You can not enter using a tourist visa with the intention to get a Green Card. USCIS will likely deny you and accuse you of fraud.

I am married almost two years, and why would they think I'm a fraud I entered with the intention to visit but then we decided to apply for an adjustment of status whats wrong with that? that's what this form is for isn't? for a situation like mine.

No. It is not for a situation like yours...

You entering with the intention to stay was misrepresentation at the POE and you will have a hard time saying otherwise... you changed your mind in 2 months?

I am only playing devil's advocate here... I am telling you USCIS will suspect of fraud... not of marriage fraud... but of your intention when using a visitor visa. This visitor visa requires you to come visit for a short visit and have no immigrant intent and you clearly had it... either concealed it from the immigration officer or were lucky...

Again, this is nothing personal and I am not accusing you... But USCIS will... you are better filing for a K3 visa or wait 2-3 more months before filing, if it was indeed your intention to NOT stay here.

OK thanks, I think I'll explain we decided to stay because my wife wanted to have the baby in the states and we liked it here.
can you direct me how to start? do I need an immigrant visa number or do I just fill in the forms and send them?

              thanks for the help!
