    Hi, I am married to a US citizen and we are in the states and I am about to file for adjustment of status, back in my country Israel I have a criminal record that I wasn't convicted for and it's not suppose to be on my background check,
    I called the immigration office and talked to immigration officer and she said I don't have to mention that I have a criminal record if I wasn't convicted because they look only for conviction, my illegal act was using an air gun without license which is considered a toy here in the states, but back in my country they took me to court for that but did not convict me.
    this is my only record except that my record was clean.
    I am still concerned about this and would like to know if any one could give me any advice about my situation and what should I do?

    For fingerprint checks and FBI background check after I-485 application, they will check your criminal records most within the United States.

    FBI fingerprint checks are conducted for many applications. The FBI fingerprint check provides information relating to criminal background within the United States. Generally, the FBI forwards responses to USCIS within 24-48 hours. If there is a record match, the FBI forwards an electronic copy of the criminal history (RAP sheet) to USCIS. At that point, a USCIS adjudicator reviews the information to determine what effect it may have on eligibility for the benefit.
