    Folks,
    Just got this email alert that EB2 and EB3 category has been retrogressed. I just got my -I-140 approval under EB-2 category and am trying to get everything ready.
    My question is ..does this apply to me?. My priority date is 2002. If I can't get the papers ready now, do I have to wait a loooooooong time before I become eligible.?

    If your PD is EB2 2002, your's is still current as of the September and October bulletin. You have until Oct 31st to file for 485.

      Thanks for the update. I got this email and got confused.

      Effective August 1, 2008, the employment-based EB-2 category priority date will advance for mainland-born China and India. The priority date advances to 01 June 2006. This means that if your I-140 was filed on or before this date, you will be eligible on August 1st to file for adjustment of status for you and your family. If you have already filed for adjustment (I-485), the USCIS will automatically process your adjustment. For all other countries other than China and India, the EB-2 category is still current., as it has been.

      Please contact our office if your priority date is on or before 01 June 2006 and you wish us to file for adjustment of status (if not already filed).

      For EB-3 category, all visas are unavailable, and remain unavailable through the rest of the fiscal year (Sep. 30, 2008).

        Replace I-140 with Priority date or labor petition. Some dumb paralegal composed that message.

        Also, the October bulletin is out and you are referencing the August bulletin? Unbelievable!

          I checked the October bulletin too. It says the same thing. The deadline is Sep. 30, 2008
