    Hello,

    I would like to hear counsel or others experience related to their dependent applicants (children) becoming adults while I-485 is still being processed.

    The current situation is:

    My and my son (currently 16 years old) I-485 is being processed. My EB2 priority date is 11/11/2005. The I-485 receipt date is 08/31/2007.

    What happens if the I-485 is still being processed and my son turns 18? does he have to apply again? does he have to apply as an internation student in universities here?

    I much appreciate hearing from people with similar experiences.

    My Kids are 19 and 20 ... and LAwyer says new interpretation is that there age is frozen at 485 filing if 824? is filed... This can be a lead for more info.. I know there was some waffling on this.. I have to recheck again..but my lawyer was top notch guy but the interpretations go back and forth sometimes.

      This is what I got from another place:

      Guys,

      don't worry.

      The age determination for the purpose of aging out is done at the time of I-485 filing and not adjudication. You guys are safe!

      They can't age out children just because they sit on an application for 5 years...
