  • When could i receive my RFE and GC approval?

    I485 stage (thru H1B)
    Notice Date: Oct 3, 2001
    EAD: Jan 15 received, valid until Nov 2002
    FingerP: completed Dec 27, 01; received by INS Jan 17
    Handled by INS CSC, I work in Phoenix.


    -When would I be receiving RFE( its really important)?
    -What if I got into job situation prior to 180 days, should I still wait for and pursue RFE thru current lawyers? Or thru personal/new employer's lawyer?
    -then, when approx. my GC approval could arrive?
    -optionally, can my spouse start working on EAD? As spouses H4 would no longer be valid, would my H1 status be at risk and change to something else?

    1. Anytime.. If you are anticipating one
    2. Better with personal lawyer so that there is no conflict of interest (you are not sponsoring employer's lawyer's client)

    4. Spouse can work independently on EAD. This will not affect your H1 status.

      In California, RFEs arrive usually two to three months after fingerprinting.

      A personal lawyer is best, but the lawyer for your new company is likely to be willing to help you out. Ask your HR department if they will introduce you to the lawyer.

      In CSC, green cards are usually approved two to three months after fingerprinting. This is USUALLY! 70% of cases are approved in this span, with 10% approved earlier and 20% later. So don't worry if you're a bit late. It might be nothing.

        Thanks both of you for prompt responses.
        My Current job lawyers are good too( its just sometimes we got worried).

        Question:
        - How does RFE arrives? By Mail directly to me, or thru lawyers, or by both ways? My officemate told that only the lawyers got it.
