  • What to extent ead or h1

    My EAD and H1 both are expiring in OCT 2002.
    By OCT 2002 my 6yr cap is getting over.
    So far I did not get even my FP notice. MY RD is 08/09/01 and ND 09/19/01.

    What should I do? Do I need to extend EAD (I hope Yes)?
    Should I ask my company to extent H1?
    Is it possibile to extent h1 even after 6years cap is over?
    If yeas then extention will be for how long?
    I fear that my company will not extent h1, due to cost involved.
    Any idea about the cost for h1 extention?

    Any help is higly appreciated.

    Since it is more than a year from RD EAD is getting a little bit safer for you.
    However EAD or H1 is purely personal choice. if possible I would do EAD.
    yes you can extend H1 into the 7th yr, but that is not going to help you if your 485 is rejected. Here is why: If 485 is rejected, on what basis can you do a H1 transfer? Since there is no new LC or 140 pending for more than a year at the time of rejection, AC21 is not going to come to your rescue and you will be past the 6yr limit.
    EAD also means that you have control (you can apply by yourself) and you are not bound in slavery to a company.

    Cost of h1 extension: Including attorney costs might shoot beyond 500, cost of EAD: 120 and document costs (photo, postage...)
    Got to keep on renewing EAD proactively though...
