    Hi, I'm new to this forum but I have a quick question that I thought perhaps you may be able to answer.

    I am aware that when someone applies for AOS they are eligable to apply for a work permit whilst the AOS is pending, but what about the children?

    Is there some form of application that can be made that would allow them to attend school while AOS is in progress or are they allowed to attend school anyway?

    I would just like a little clarification on this as I obviously cannot apply for a work permit for a child!

    Could anyone shed any light on this for me, please?

    EAD is needed to work. For children, just the fact that they have a 485 pending makes them eligible to stay in the US.

          Thank you, that seems to have made things a little bit easier. Do you know anywhere where its stated that they can attend school? I need to make sure I have all the right information and need to find out how you would go about applying to put them in a school.

          I don't know if it is so simple that there isn't much information about it or whether i'm just dim

            Go ask the school in your area. Only restriction is one cannot change to F1 status with AOS pending.

                Ok, I just looked into F1 and I understand where that is comming from now. I have 2 children both under 14 and i'm just not sure what i'm supposed to do to get them into school.

                If i were to go to the local school and just ask, will they know and let them attend without any kind of form other than the knowledge of a AOS pending?

                The system is rediculously confusing. I think by the time i'm adjusted i'll consider immigration law schooling...

                  They can study as AOS pending or parolees in schools as well as higher education. No issues. All schools know about these.
