Help Please - H4 to H1 Change Of Status

Hi,

I have been on H4 dependent visa since last one year. I got my H1B approved this year which became valid in Oct 2008.

My sponsor is a consultancy company and they are unable to find a job for me given the market.

Is there any provision that I may remain on H4 status till the job market conditions improve and then once I start getting job offers can I get my H1 activated then?

Is this possible? Wouldn't I stand to lose my H1B status?

Any pointers would be greatly appreciated.

Read the FAQs. It will be clear.

Your employer must pay you for the time you are on H1b. If not complain to DOL on a WH4. Once cap counted, you have the H1b for your use later on with any employer.

You are out of status and no status changes in US allowed.
