L1/L2+dependents, GC processing..kids cant work, cant leave US, HELP!!!

    Hi

    I am hoping someone may be able to shed some light on our situation before we all become totally confused.....

    WE moved to USA from UK end of 2006, My husband is a L1 visa holder, myself and 2 teenagers (20yrs and 16yrs)are a L2 and L2 dependants.... our first visa was for 1 yr and expired in nov 07, our attorneys eventually renewed it in march 08 and eventually submitted our GC 8 months later than planned in june of this yr.....

    Throughout the last 2 yrs our attorneys have informed us we would never have to go to the London embassy again to get our visa stamped for renewal and that we would be able to move between US and UK without a problem...... we have just found out that London is the only place to get them stamped.. due to all the incorrect information given to us over this , we do not trust that the restamping of our visa will be that straightforward, unless the whole family is there.. even then we are not 100% sure this is accurate. Does anyone have any information on this?

    The main concern is our son has just graduated college but cannot work as L2 dependants are not entitled to social securty number.. does anyone know if there is anything that can be done for him to get a social security number? I have searched sites, call USCIS, even Border control trying to find someone who can help me... i just seem to get nowhere...

    I cant even find out what the process for the GC is.. we have had fingerprints done but do we have an interview??

    I understand from the processing times on uscis, that for the GC Texas processing times, they are currently working on cases received in june 2007.. does that mean they will be working on june 08 in nov 09???

    Any advise is extremely welcome.....

    Is your husband on L1A or L1B? That determines how long it takes for the GC. They can definitely leave US with advance parole.

    Except L2 spouse, children cannot work and if you have applied for GC for all, why did they not apply for EAD? What stage of GC is in process? The I485 I guess as you mentioned finger prints.

      He is a L1A visa holder.. I ofund out a few days ago about the advanced payroll, but our attorneys have told us we cannot use this is only for 'aliens out of status'.. our renewal visa is valid till 2010.... can we get the green card processed quicker?

        sorry pressed the butotn to quickly, yes we are at I485 status, the first leg of the GC i guess...? they cant get an EAD as they dont have a social sec number, so we have been told....

          Actually, it is the opposite. One that is not eligible for a SSN gets the EAD and then qualifies to get the SSN. If your kids have also applied for I485, look at the EAD section of this website and follow the C(9) category to apply for EAD for all of you.

          Yes, L2 spouse can get SSN first and apply for EAD later on. Other visa categories that do not qualify to get SSN do the vice-versa.
