  • I-485 Pending & Rough U.S. Economy

    Hello-

    My Wife and I are waiting for our I-485 which is currently pending. I have my H1B extended to 2011. Our priority date is September 25, 2006. The current Visa Bulletin posted as of today, Nov 22, 2008, for December 2008 Bulletin is May 2005. My wife and I holds a work permit. (were both currently in the U.S. working)

    The company that I worked with is a large one. about 320+ employees and currently terminating people because of recession. We are now down to about 240+ and the layoff goes on and on. It doesnt stop. This worries me, though a lawyer told me that In case I get terminated, I could use my work permit and find another employer and use the approved I-140 of the same job description that I had presently. But with this current job market, there is no job anywhere in my field. I have colleagues that were terminated 4 mos. ago and still out there looking for work.

    What is my best option if I lose my job and couldnt find work for at least 6 mos.? What will happen to my I-485?

    You are required to be working in the same/similar job at the time of the I485 approval.

      thanks, I understand that.

      but would there be any option to retain my status in the US if my I-485 gets into trouble when I get terminated at work due to current economic status?

        If it is past 180 days of filing, you will be a parolee as long as 485 is filing. You need to have the job by the time of 485 approval. Talk to your attorney.

          My 485 was filed August 2007. More than a year ago.

          How long would I stay as a parolee status (485 pending) (if) after I get terminated from work?

            The law does not specific about the duration as GC is for future employment. Consult your attorney.

              In my 485 case that was filed more than 180 days, what does it really mean when it says Im on parolee status?
