Hi,
I am in dilemma whether I go for H4 stamping or not because of below concerns. Could you please clarify below questions?
I came to US on h4 and changed status to H1. Applied for I-485 as derivative in July 2007. My current H1B expires in Jan, 2009. But, I had not been working on H1B since July 2007. I am authorized to stay in USA based on my I-485 and out of status on H1B right. Now I am in India. I am planning to apply for H4 stamping along with my husband in next month. If I apply for H4, will it be abandoned my I-485?
A person need to maintain non-immigrant visa status (H4 or H1) before he/she leaves US to apply H4 visa stamping without abandoning I-485 status?
Please help me in this regard.
