    Hi everybody,

    I'm a new member and I have received a letter in the mail for our initial i-485 interview the first week of January.
    I overstayed my visa by 4 years. The other thing against me is that I had been previously married. Although the first marriage was annulled, there's still record of it in our marriage license.

    Our marriage is legit and we have no shortage of proof. We recently moved to another state and my husband, who is the petitioner, has been currently unemployed for the past 2 months. He's had a steady job since we met and all taxes are up to date.

    I was wondering if hiring a lawyer to come with us on our first interview would be helpful considering I have a few things going against me?
    Any advice would be great!

    1) The lawyer can do NOTHING for you. Regardless of your case, they are a waste of money at the interview. They are not "allowed" to speak unless the IO is violating your rights.

    2) Who is your sponsor? I-864? if it is your husband, then he needs the last 3 months worth of paystubs... you may have to find another co-sponsor and bring their tax and paystubs information, plus a signed I-864 from them.

    3) Your overstay will be forgiven, for as long as you entered legally and you are married to an US citizen, you would be fine.
