  • FOIA to request labor documents

    Experts, please help me
I would like to request copy my labor documents 750A and 750B.

    1) Where should I send completed g-639? In g-639 instructions 3 options are given and I am

not sure which is applicable to me

Below is the text from g-639 instructions
"Depending on the type of record you are seeking, Freedom ofInformation Act (FOIA) or

Privacy Act (PA) requests shouldbe submitted by mail to the following locations:

    Alien Files -
National Record Center (NRC)P. O. Box 648010Lee's Summit, MO 64064-8010

Human Resources and Procurement Records -
USCIS FOIA/PA70 Kimball AvenueSouth Burlington, Vermont 05403-6813

Remaining USCIS Records and Border Patrol Records -
USCIS National Record CenterFOIA DivisionP.O. Box 648010Lee Summit, MO 64064-5570"

    2) Is there any risk in requesting copy of my 750A and 750B, like delay in my I-485

processing? FYI, my priority date is Jan-2007 and the current processing date for my

    category is only June-2003

    3) How long would it take approximately for me to receive my 750A copy?

    4) I am planning to change my employer in another couple of weeks, and will wait for these

documents to arrive before invoking AC-21. Is that a good decision, or will that be too late

by the time when I invoke AC-21?

I am in a critical condition and need to decide. Your suggestions and advice will be very

helpful for me. Thanks in advance.

    1. I am guessing NRC. Could be USCIS one as well. Not sure.
    2. No risk.
    3. They have stipulated timeframes as per FOIA rules. They will respond based on it. The more info that you provide as the date of filing etc, it will be easier and faster for them to locate it. Reply back to the forum once you obtain so that others can benefit from it.
    4. Depends. If your GC PD becomes current and your AC21 has not been filed yet and you get the GC, you will have to work with the same employer for 6 more months to be safe.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
