OK here are the facts:
1) My PD is Oct 2002.
2) My Green card is already approved.
3) I got married before my green card was approved.
4) My spouse is currently on H1B visas.
5) We have a US born child after our marriage.
Questions:
1) Can my spouse apply for a hew I-485 based on my approved green card.
2) If my spouse applies, will the application be accepted and approved? Note: the current PD for India is Oct 2001.
3) If spouse has to wait till PD gets current, what are the options?
