  • Waiting for AOS for over three years

    My I485 was filed in Feb, 2005. My wife was the primary applicant. She received her green card in May, 2005. Our daughter received her green card in July, 2005. All three I485s were filed at the same time. I am still waiting approval of my I485.

    Since then, I have received multiple EADs. I called USCIS multiple times. First they said that my application is waiting for "security check". Now, there is no specific information. They just says that it is waiting for processing. During this process, my application was transferred from Vermont to Texas.

    I also wrote to FBI. FBI sent me a letter saying:

    Date received in NNCP: 3/xx/2005
    Status: Finalized
    Date Finalized: 10/xx/2007

    So, it seems that FBI responded to their query over a year ago. Still there is no response from USCIS. The last status (online) was changed in 8/2008. Basically, there was no change. Just the date was updated.

    Please suggest what actions I should take. I have taken an InfoPass appointment.

    What documents should I take their?
    Are their any specific questions I should ask?

    I am afraid they may just that the application in is process.
    Please help.

    You should consider a Writ of Mandamus. Consult an attorney that has done this.
