  • Aos frustrating process, please help help help!!!

    Well, I got married to my USA citizen husband last august( here in the USA, I entered on a B-2 visa) and this AOS thing has been a little bit frustrating for us. We sent all our applications and forms on october and to make the story a little bit shorter I'll tell you that we sent the I-130 and the I-485 ( that's what we were told by the USCIS that we needed) but we did not sent the form for the employment authorization and the one for the advanced parole since we didn't knew that we were supossed to send that also.

    Now, I'm gonna have my fingerprints taken this friday comming up and I really dont know what's comming after that...Should I still file for the EAD even though i'm going for my fingerprints this week already. Can anyone tell me what's going to happen after this? Do I still have a long way to go ? Should I wait for the GC and not file the EAD?

    I'm very desperate,my dad in my native country is having a very delicate heart surgery and I would like to know if there's any way I can get a permit to get out of the USA as soon as possible since my dad is not doing well and I'm afraid not to be there if he don't survive the delicate surgery he's having.


    Please , please help me, I'd appreciate your help with my heart if you can answer to any of my questions!!!

    If you were out of status when you filed then you cannot use your AP to enter the country regardless you apply for one and was issued one to you. You cannot leave the country once you file for I-485, otherwise it would be considered as abandonment of your application. Regarding EAD, you still can apply for one, but after the interview, if all goes well, you will be receiving the actual G.C. in about 4-8 weeks anyways. At that time you can travel too with the G.C.
