I entered US in 2003 as a visitor and go status changed to H1-B but did not go back to get stamp in my passport. I-140 is approved and I-485 was filed in August 2007 and is pending. We travelled to India on Advance parole in 2008 and entered back in US on advance parole.
My wife's I-130 petition was filed by her US citizen sister in 1997, now visa number has become available for her catagory F-4. My question is can we go for Adjustment of status for our family based green card or we would have to go for consular process. Can we transfer our pending I-485 ( Based on EB3) to Family catagory F-4.
Please advise.
