  • Confusion with applying for SSN

    My wife has following status/documents and she needs to apply for SSN
    1. I-485 receipt notice
    2. EAD card
    3. Passport with L2 Visa and unexpired I-94(but that's not valid as my status has changed from L-1 to GC holder)

    What would be her immigration status for applying SSN as SSA website mentions a mandatory I-94 card for applying SSN for non citizens.

    It may be hard to explain them that although there is an unexpired I-94 in her passport, it is not valid.

    Does she already have a 485 pending? Is the EAD from the 485? If so, there is no issue getting the SSN. Her status is a parolee.

      She has a 485 pending, based on which she got EAD. Problem is that SSA website mentions only I-94 for immigration status document even if parolee.
      In her situation, the status changed since she entered last time with L-2 status. Though L-2 status shown on I-94 is for 2 more years, it is not valid as I don't have L-1 anymore.

        The I-94, though not valid is the I-94 she has and that proves that the person entered US after inspection. She will be fine. Take the EAD, 485 receipt, PP, I-94 and it will not be a problem.
