  • does a divorce mean having to leave the us?

    what will happen, if someone that got married to a us citizen and has filed for his/her green card (very early stages) when that person gets a divorce? i think that this person will need to have the leave the us, but what option may someone have, if he/she gets blackmailed by his wife/her husband threatening to divorce them, so that they will have to leave the country? what can a person do to NOT be blackmailed by her/his spouse? if someoen could answer that for me i'd greatly appreciate it. thanks. svet

    If he or she is being blackmailed, gather real hard evidence of this(which is difficult). He or she should hire an experienced attorney when he or she file removal of conditional greencard, and use the evidence(if he or she have them). The attorney should know what to do. If he or she is being blackmailed, and he or she entered marrigage in good faith, this might be a form of being abused.

      it depends..

      i read about it here in IMMIHELP. if they see something wrong to the of you. immig.will give you and your husband a marriage counsellor to know who is telling the truth and what is really happening to both of you,if you are a battered wife,immig. will still giving you your GC and able to stay in US,

        similar problem

        i have a very similar situation,the only difference is i travelled to find some money ,when i came she started verbally threatening ,then she ran away ,swept all stuff in the house .nobody knew were she was ,i called the police ,we searched with the detectives .we finally managed to find her ,then she told the detective she doesnt want to be bothered or contacted or at least tell me were she has ran to .i want to divorce ,but i cannot because i require her signature .i want to go home ,i m sick and tired ,this is mental torture ,i cannot remarry or go leave the country and marry ,plan anything because everything is hinged on that .i cant .
        i v set a date for conselling at church ,i m doing it for us and one for myself but i doubt she will show up.i m went to court to file for emotional and mental abuse ,but i care so much ,i just got the papers ,i havent filed .
        what should i do? what do i tell uscis .this is sick for uscis to think its people are so super perfect,this is abuse.

          what if they were here before on a student visa, but after applying for aos their "international student status" was removed? is it better to withdraw the aos before the first interview, divorce before the first interview, or just do the interview and wait till afterward to divorce?
