  • I-94 taken at interview

    My wife is applying for permanent resident status based on our marriage. She is currently in the US on an F1 visa, and we filed the I-130 concurrently with the I-485.

    We just had our interview at the USCIS office today, and the interviewer took my wife's I-94. She did not approve our case - in fact, she specifically said it would take another 2-4 months of processing. She did not say anything specific about why my wife was not yet being accepted, saying only she would contact us if further documentation is needed. She did not stamp my wife's passport or issue any form of advance parole. She told my wife, if asked, to say that her I-94 was in the possession of an immigration officer.

    Did the interviewer act properly, and if not, what recourse do we have? My wife is very worried ...

    I'm sorry that the IO didn't approve your wife's case immediately. Based on what the IO told you, USCIS might be requesting for further documentation to approve it. At this point, there is nothing much to do but to wait for an RFE and to give it to them as soon as possible. I hope the request comes sooner than 2 months though. Hang in there. It's better for your wife to remain in the US while waiting for her AOS to be approved, specially now that the IO took her I-94 (I think it is SOP). If USCIS decided to take time in reviewing your wife's AOS, they'd probably send the AP to her so she can travel while her case is pending. In the meantime, pls tell her not to worry too much... it won't help. If you have some queries though, you can call their customer service no. 1-800-375-5283. Dial 123 as soon as you hear the recorded message, to talk to a live operator. I've done this 3x in the past, and so far, all optrs that I talked are very professional and helpful in my case.       IO took my I-94 too...

      Yesterday,The IO also took my I-94 without stamping my passport and he honestly said he'll not gonna approve it yet because our marriage is less than 2 years.But I saw at USCIS website that the "card production ordered" for 2 year greencard. This is my question,since I don't have Social Security Number yet and I heard they need the original I-94,how will I apply for SSN since they took it OR should I wait for my 2 year GC and use it?
