I am a us citizen-my husband entered the us illegaly 5yrs ago. We have been married for 3yrs and have one child. His I-130 has been approved-next step is I-485 it is in process. Per the lawyer he will have to go to MX to wait the lawyer said he had an 85% chance that it could be approved. My question is where is he getting this info from? I have been reading laws in the uscis web site and I dont see anything that can help you once you entered illegally and stayed more than 6 months. The lawyer also did some advance parole thing but per the uscis that would not be applicable because he has been here illegaly for >6months. Do you guys think he still has a chance to obtain a permanet resident card? Has anyone had a similar experience???

It was approved sometime in 02/07 we got married on 05/06. We had been waiting to proceed because we were hoping some new law came in where he would not have to go and process in MX but I dont think nothing is coming out soon. We got an approval letter stating that the next step was the I-485 and then we would get an interview this is where we left off. Now all we did was e-mail wherever the I130 came from and told them we would continue. So you think he has a good chance? I did not mention that when he entered illegally he was caught and deported he was fingerprinted but did not see a judge he left on his own. However you're right I think the approval of the I-130 is good start.
