  • RFE on Birth Certificate for I-485 --- Urgent Help Needed..PLEASE!

    Hi,

    I need help for the RFE on Birth Certificate for our I-485 application processing.

    This is the RFE we got from USICS.

    Submit a copy of your Birth Certificate showing your parentage, which has been registered with the proper civil authorities of the country of your birth. An abridged or "short form" document which does not indicate parentage is not acceptable. In accordance with Title 22, Code of Federal Regulations, Part 42.65(b), a record of birth is required for an immigrant visa. A record of birth means a certificate issued by the official custodian of birth records in the country of birth, showing the date and place of birth and the parentage of the alien, based upon the original registration of birth.


    Here is what we have submitted initially:

    1. Birth Certificate with no name on it. As we took the Birth Certificate after 15 years, the name was blank.
    2. We submitted a notarized affidavit with the name mentioned in 10th Class certificate and Passport.

    Here are my questions and all your valuable suggestions are most welcome…

    1. Can I get the Birth Certificate in the nearest Indian Embassy in US?
    2. Our Lawyer got this RFE by mail and he sent us the scanned copy. Do we need to send the BC to our Lawyer or to USCIS directly?

    Please suggest me what all I should do and how to get the Birth Certificate again from India before July 1st 2009.

    You need to submit affidavits of birth from your parents/relatives.

      RFE for to establish birth and parentage

      I have also received an RFE on June 19, 2009.

      It says:
      Please submit oldest available evidence which establishes your birth and parentage.

      This evidence may include, but is not limited to:

      a) Hospital birth records which name the child and both parents
      b) Medical records which name the child and both parents
      c) School records which name the child and both parents
      d) Cencus records which name the child and both parents
      e) Religious records in the form of a certificate under the seal of the organisation where the baptism, dedication, presentation or comparable rite occured following the birth, showing the date and place of the child's birth, the date of the religious ceremony, and the names of the child's parents.

      Question:
      I don't have birth certificate and while submitted my I-485 petition, I had taken the birth certificate from the Indian Embassy in New York.

      What should I do?

      My school certificates such as 10th Standard & 12th Standard has my birth date and father's name on it.

      Will that be enough? Please confirm.

        No, you need affidavits of birth from parents and or relatives that are at least 10+ years older than you. You can find the formats online.
