  • I got my GC in 3 MONTHS after filing AOS

    Hi to all,

    I received so much info on this site before filing my MARRIAGE based application to adjust status (I-485) that I thought I must share my own experience here. I filed WITHOUT the assistance of a lawyer and was still able to become a Permanent Resident this last Monday, only three months after filing.

    First, here are my timelines:

    March 06th , 2009 FILED APPLICATION (CHICAGO LOCKERBOX)
    March 11th RECEIPT LETTER mailed to me
    April 3rd HAD BIOMETRICS TAKEN
    April 13th NOTIFICATION LETTER OF AOS INTERVIEW mailed to me
    May 1st ADVANCE PAROLE DOCUMENTS mailed to me
    May 4th EMPLOYMENT AUTHORISATION CARD mailed to me
    June 15th HAD AOS INTERVIEW (Philadelphia, PA)
    PASSPORT STAMPED
    June 19th, 2009 RECEIVED WELCOME LETTER (which notified me that the
    actual GC would be mailed and that I should receive it
    within 3 weeks)


    How did I file?
    --- I submitted all the documents they requested and more.

    EVIDENCE TO SHOW THE BONA FIDES OF MY MARRIAGE RELATIONSHIP

    - Two affidavits, both signed by a notary public. The first affidavit from my country of origin, the second from the U.S.
    - COPIES of two leases, showing joint tenancy, one from my country of origin and one from the U.S.
    - A COPY of my life insurance policy that quotes my husband as the beneficiary if I were to die.
    - COPIES of Homeowners and Car Insurance Policies with both our names even though I don’t drive.
    - COPIES of Bills that show joint responsibility
    - COPIES of Bank statements showing joint account
    - Photographs of our wedding, courtship, time spent with each other’s family.
    - A COPY of a letter from my midwife stating my due date and that my husband attended my prenatal appointments
    - A COPY of Our marriage certificate

    EVIDENCE OF MY SPONSORS INCOME

    - A COPY of a Letter from my husband’s employer
    - Husband’s Tax returns for 2006 and 2008
    - Letter explaining why he was not required to file in 2007.


    MEDICAL EXAMINATION

    - a Clean Bill of Health
    I was allowed exemption from the MMR vaccination because I was 5 months pregnant.
    However note that if the TB test is positive for a reaction you will be forced to get a chest X-ray, even
    while pregnant. Thank God mine was negative, I would leave the country before exposing my unborn
    baby to x-rays.





    MY INFO
    - My birth certificate
    - colour photocopies of the biographic pages of my passport
    - colour photocopy of the page on my passport with the U.S. Visa I used to enter.
    - photocopy of my I-94 (back and front)
    - the required passport sized photos



    Properly filled out forms (Affidavit of Support, Petition For Alien Relative, Applications for Advance Parole and Employment Authorisation, Adjustment of Status and Medical Examination)

    Organisation
    I used paper clips to attach the checks to the top of each relevant application - I think it was $1,010 for the AOS and $355 for the Petition for Alien Relative as everything else was a part of the AOS application.
    I also placed the loose passport sized photos in tiny ziplock bags and stapled them to the side of the relevant applications. I also separated each application with a plain blue sheet of card the same size as the applications and wrote the name of the application on the front of the card, if I had files I probably would have used those instead. Anyway, you want to be as neat and orderly as possible.

    I received no letter about “Further Evidence” probably because I had sent them more than they needed and I had tons of people praying for us.

    Well I’m over 8 months pregnant now and I am feeling very nauseous as I’m typing this and so I will have to come back and describe what happened in my MED EXAM, BIOMETRICS and the all-important AOS INTERVIEW at a later time - Unless of course I go into labour….

    Hope this first bit helps someone somehow….

    Congrats and thanks for sharing

    The moment you wrote that u are 8ms pregnant I realized I saw you in the waiting room on the 3rd floor in the Philly office on June 15. My son and I were there while I waited for my citizenship interview. All the best and happy delivery.

      Oh wow, thats awesome thanks!! Baby is still in but Im hoping he comes out soon I hope all went well for you Sorry for the delay in replying- Ive been very ill this last month.

      Anyway, Its been so long now I think I almost forgot what the interview was like but I'll try to remember something:

      Okay the interviewer called for me like 5 min. after we got there and I had expected a long wait so I was in the bathroom ( I blame the pregnancy)
      Anyway it wasnt long before we were in a tiny room with a plain clothed IO and a uniformed man who just sat behind her and said absolutely nothing.
      The IO made a joke about the restroom and proceded to ask me questions that I had already answered in my application (those regarding terrorism and other illegal activities) She also asked what would we do if my husband lost his job, do we have family nearby etc. They just want to know that you are not going to become a dependent of the government. She wanted to know how we were paying for the baby since we didnt have insurance. I showed her receipts that proved that we had already paid for all prenatal and delivery care upfront.

      She asked for any further evidence to show the bona fides of our marriage -- we showed her pictures of our courtship, engagement, time with each other's family, wedding, day to day life. We had our wedding video on DVD but of course they didnt have time for that... which I knew but I just wanted to say I had it. We had copies of other documents that they seemed to have 'lost' but she acted like they never received. MY ADVICE IS WALK WITH COPIES OF EVERYTHING YOU SENT THEM, AND ALL ORIGINALS.

      And she asked how many times I had been to the U.S and when did I arrive each time.

      It was all over in about 20 minutes I think and then she said that she will stamp my passport now so that I wouldnt have to wait. So hubby and I exited that room, returned to the main lobby and 5 minutes later another lady called my name from a different door and she handed me my passport with my new red "greencard" stamp, notifying me that I could travel with it and the actual card would be mailed to me. I also received a letter that said "Welcome to the U.S" and I was told that the card would take 3 weeks to arrive. I thought 3 weeks -- yeah right! But, it came in 2 weeks!! Thank you God!!

        Congratulations. Quick question what kind of visa did you enter the US with and is your Husband a green card holder ?

          Hi, I entered on a visitor visa (b2) and my husband is a U.S Citizen. Hope that helps somehow...

            Hi thanks for all that helpful information
            I just got married to my husband (US Citizen) -(We have lived together for 8.5yrs in the US)
            I also came on B2 visitor visa which I have lost (my entire passport) I applied for a replacement 194 now i am ready to for my AOS.
            I am a bit confused about filing the relative petition? I-130
            Being that I am in the US does he still have to file that for me or
            should i just file adjustment of status I-485.

              You do have to file I-130 petition it doesn't matter where you are, here or in China. It will give you a visa number that let you apply for AOS (I-485).

                Thank you very much on valuable informations!I have several questions for you linked with the fullfiling I-130 and I-485 form.I'm wondering when i'm recieving approval notice after submittin' I-130 form?Do i have to fullfil I-130 and I-485 form by myself or my spouse,she is US citizen?I'm under age 21.I'm studying outside USA ,overseas ,so is it possible to wait for an AOS interview outside USA?Does that fact has an influence on a final decision of getting green card?

                  And I have one additional question.Do I have to fullfil I-131 form for advance parole if I want to leave USA for threee months because I have obligations toward my university settled outside USA,and then to come back to USA to pass AOS interview?

                    And for how long i'm waiting for advance parole?Can I fullfil all the forms conccurently and send them together to the office in Chicago?Can anyone give me an answers on this questions!

                      I don't have much information.
                      For what you are saying I believe you live here but study overseas.. Is that correct?
                      First of all if your wife is a US Citizen you can fill the AOS package (I-130, I-485, I-765) while you are in United States . You can only adjust status while in the country. About the advance parole... is kind of risky if you do not have an emergency reason from which you will have to travel while yur AOS is pending.
                      The process is very fast if everything is in order aprox. 4-6 months to get a green card!

                        Well,i'm studying and living in Europe but i'm getting married to US citizen,because we are in love.I tried this year to study in USA to be closer to her and got accepted from several universities in USA but money was a problem,because i'm international!I'm going to USA in mid september,and courses on my university are taking place in mid october so that means i have to back home by that date.I'm planning to marry with her and to fullfil and send an application to USCIS,but i'm worried about advance parole,because i really want to keep studying in my country until june next year and then to go to USA.My girlfriend is a student too,and she recieves a financial aid.Do the marriage will affect amount of financial aid she recieves?Can i prove to USCIS that i have emergency case to get advance parole earlier,because it's about school and education do you think that they will understand a circumstances?Another thing that i need to do is to go back to USA probably in january as I understood to pass AOS interview.Can u tell me approximately when USCIS is making appointment to AOS interview after all documents are submitted to their offce!

                          like I said it takes about 4-6 months to get an interviewfor AOS.. you are going to have to prove that is a bonafine marriage, and living together I believe is one of the requirements. I think you should ask a professional on this.

                            Maybe she should get a fiance visa, and you will able to travel... but Im not 100% sure. And you need an sponsor, that will be financially responsable for you, her income should be 125% or higher of poverty guideliness wich is about 23K. If she doesnt meet that she needs to get a c-sponsor. I'm sorry I dont have a siure answer. You can always call USCIS and ask them.. they know best!

                              Can her mother be a co-sponsor,because she is dependent on her,she will her job this,and i will as as a come to USA next summer?
