Working independently using EAD and maintaining employment

Can a EB2 person, I-485 Filed < 180 Days, use EAD to work independently (not on W2) for the employer who is not sponsoring GC. Employment with current employer is still continued, but no salary. Is this affects adversely to AOS/GC process. Reason for this is person is on bench without salary.

Is it ok with INS if person is on bench without salary while applied AOS.

You cannot be on both EAD and H1 simultaneously. This means that you have to use EAD with your sponsoring employer also. But using EAD you can do whatever type of job you want.
