  • Expired passport URGENT!!!

    My passport expired a few months ago and recently I got married to a usc will the expired passport have any adverse effect on my filing?

    I have not yet filed anything because I am still waiting on the medical reports only 2 weeks of waiting now...yeh lol

    Also for the I-485 part 2 if I check box "A" because I am concurrently filing an I-130 with an I-485 would I be correct in doing so or should I check "H" and write that I am married to a usc?

    USCIS agents gave me two different answers.

    I called last friday and was told part 2 of the I-485 for my situation which is married to a usc but my previous visa has expired is option A because I'm filing concurrent.

    I called back on Monday before I mailed anything to double check and was told I should check H

    WTF?

    Does anyone have the right answer for my question?

      choose A. It's my personal experience. I made the exact mistake by choosing H, which threw the Immigration office off.
      as your expired passport, Just go to your country consulate to renew your passport. my passport was also expired, I just submitted my interview notice and marriage certificate to the consulate, and I got my new passport. good luck to you! expired passport doesn't affect your case, as long you entered the US legally.
