    I have an approved I-130 Petition by my US Citizen spouse. I have been on removal proceedings, and I am currently scheduled for an individual hearing because of the approved I-130, and I have filed in an I-485 with the court but I need to leave the country for an emergency. How do I obtain permission to leave and return to the country? Thanks.

    You can file an I-131 (Advance parole).... but depends on your situation... Leaving the country (even if your application is pending with USCIS) can trigger the 3 to 10 year bar for you to come back. It depends on your status also. If you are out of status sand have been that way for over 180 days or more you could get the 10 years bar on you, from whitch you can NOT come back to the country until is over.

      Well my petition has been approved (I-130), and my hearing has been scheduled for next year (with the judge), however, I have an emergency and I need to leave the country as soon as possible. Any thing I can do? Thanks.

        I agree with you BribeAl! If I am in your situation.. I stay and wait here in US until my papers are done.. you'll never know what the USCIS will come up after you leave the US....althou your spouse can file a waiver if ever you will be subject for 3-10 bar but still if will take awhile before you can come back here... and it will be on the discretion of the USCIS if they're gonna approve the waiver of your spouse... so it's up to you... at the end of the day you'll be the one to decide...
