I-485 denied because of expired H4.

Please help. My wife and son I-485 application has been denied because their H4 had expired. The H4 visa was valid between sept. 2003 to sept. 2005 but my attorney did not file for them when I renewed my H1b, we found that out during Immigration interview on Aug. 3, 2009 which he admitted. We did applied again for the h4 in sept. 2006 but it was denied.
My I-485, I guess was approved during the interview because I received a visa regression letter. The officer said he would have to review my wife and son's case with his supervisor. My attorney insisted it will be okay for them because I was approved. Today, we received letter of denial for both and it gives us the option to file a motion to reopen or a motion to reconsider. What is your advice? I do not trust my attorney now.
