  • married to a US citizen and on a F-1 visa

    Hello,
I am in the US on a student visa and my wife is a US citizen. We have not filed for my adjustment of status yet. My student status will soon be terminated because I have not registered for classes. It may take us 2 or 3 weeks to gather all the documents before we can apply for my green card. Will I be able to apply for adjustment of status after my status has been terminated? What should I do? I have no intentions of breaking any immigration laws so please help!

You should try to send in the AOS paperwork ASAP. If you lose your status and apply to adjust status to a GC, it will not be negatively impacted as long as you had a valid entry into US through a POE and you are married to a USC but you cannot travel with a AP as it is risky. You should wait till the GC is approved to travel.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
