  • Separate Filing I-130 for my daughter and I??

    I have daughter who is 11 and not his child, she migrated to US with me.
    I would like to adjust my status and her also
    My husband a USC is filing the Alien Petition I-130I for me
    Im assuming he would have to file a separate petition for her too including separate fees.

    My question is when i mail it in do I mail both of them iin the same envelope
    or do i mail hers separately.

    Sorry if it seems dumb but Ive searched on this forum all morning long with no answer.

    That was a typo
    the form is I-130

      Hi,

      From what I have read ( read the instructions pages on the I-130 or search the USCIS page) your daughter is a beneficiary and hence one form should be filed for you, listing her as beneficiary. But you will need to file 2 AOS forms - one for you and one for your child. Again, this is my understanding. You can always call USCIS customer service line and ask them. This is a yes or no answer.         hi,
        i have a 13year old , and i filled out 2 separate forms I130 for each of us with each filling fee, and 2 separate AOS with their filling fees.
