Being a Canadian citizen and crossing the border on land, I did not receive an I-94. This was 2.5 years ago.
I am being told that, even tho I am here out of status (which, as I understand it means "you're ok to stay here, but don't do anything illegal or we'll ship you back to Canada"), I do not require one.
I spoke with a community organization and was told that it MAY cause problem, or it may not. Seeing as how most Canadians do not receive one, USCIS may see this as normal and not hold it against me.
This is my first post, but I have been reading this forum a lot. My husband and I do not have a lot of money, so we plan on doing it ourselves. It's all every confusing.
The second question is in regards to the actual paperwork. I wear my husband's name, but since I was here without a SSN, I couldn't really "change my name" by correcting it on my I.D.. That being said, now that we are filling, do I use my married name?
And a third question. What is USCIS' policy or statistics on AoS. My husband and I truly love each other and want to live here. This is very stressful and I would like to know if AoS application are usually accepted. I have also been told that once I send in my paperwork, if everything is alright, I will automatically be sent an EAD.
