    Dear all,

    I received an RFE about Birth Certificate this morning. We have to respond in less than 3 weeks. This was out of the blue because 2 years back my company's lawyers had said that the Birth Certificate from the Indian Consulate in New York was sufficient. As a result we never worked to get the actual BC or the Non-Availability of Birth Certificate (NABC). Now it appears that I am in deep trouble.

    I was born in Bhiwani, Haryana and my wife in New Delhi. I don't think that in 2 weeks, we can get the NABC from these places, can we?

    What options do I have?
    - Submit affidavit from parents and 10th standard CBSE statement without NABC and hope that flies with USCIS. We already have the BC from consulate that isn't acceptable but may be useful to add as secondary or tertiary proof.
    - Somehow get NABC for wife and self also (in addition to the above).
    - Abandon the green card process?

    Does anyone have advice about getting the NABC? I searched online and this forum but didn't find anyone successfully getting the NABC sitting here in the US. My parents are here in the US as well on vacation. Can somebody share with me a sample Non-availability of Birth Certificate (NABC). What does it look like? Is it a govt form filled by someone or is it just printed on a white paper or govt letterhead?

    How has anyone managed to get such an NABC?

    I will try caling SaharaHouse and YourManInIndia next but am not sure how good they are. I had paid Sahara $20 in 2007 to get the BC but they didn't get anything. But then the lawyers said that the consulate letter was enough so I dropped it and never pushed Sahara anymore.

    NABC needs in the govt letterhead...
    Letter need to confirm that certificate is NA.

    also need reason why NA

    Better to get from local office in your country..

    you may sent your relatives to local office with enough docs... they might issue.

    BUT u need Sent back to INS in time...very important to get back on time...

      Were you able to get the NABC. I have similar RFE and they tell that it would take 2 months to get NABC. Please help.

        Hey folks, Similar situation here as well.
        A final response to a query like this will close the loop and certainly help a lot of people as to what was the route you finally went with, and what was the outcome. Will appreciate it.

          Hi Guys,
          The BC from Indian Consulate is useless. Whoever gives this suggetion he didn't have knowledge about the BC for Indian Nationals.
          If you born after 1970 you should get BC from your local authority as per USCIS.
          In your case or for other folks I suggest try to get Non Availibility Certificate from your local authority/Muncipal/Panchayat/Corportation. This is a common Form available to local authority. Now a days in Indian local offices knows what is this. You can get this certificate within a 3 day to maximum a week.
          Next step get a notarized affidavit from your MOM stating your full name, birth date etc.
          Next attach Non Availibility Certificate +Notarized affidavit+Secondary evidance as School Certificate/Hospital record etc mentioning you name and Date of Birth.

          This a simple way to get BC. Don't spend much on it. If you have relatives in India spend couple hundred rupees (not dollars) and ask them to get Non Availibility Certificate. You can request local authority to expidate or if your relative knows someone there so you can get within day two.

          This is genuine suggetion. I did same thing last year, I got Non Availibility within 5 days, meanwhile i prepare notarized affidavit.
          They can scan from India and send you or fax you. Your parents are here so you print the document and notarized with any notary and attached their passport copies and visa page, to show they are here and you got affidavit from USA.

          You still have 60 days to reply. (I think).

          For the affidavit document you can get sample documents from Immi help they have a good sample one's. Changed name, address, mother name etc.

            Thanks zoom123 for the detailed response. I was told by one of the online services, that New Delhi does not provide Non Availability certificates. If your registration record is not found, you need to make a new registration which usually takes longer. Maybe this depends on the year of birth, but I'm not certain.

              I have a similar situation where the panchayat is not issuing NABC but another panchayat in the same district is willing to issue a NABC certificate.

              Is it ok to submit an NABC from a gram panchayat different from the place of birth on your passport ?

                Hello skj97 ... what was the outcome on the NABC front ?

                I want to file GC for my mom DOB in 1956 and we are having tough time getting a NABC itself from the Village Authorities as they are pushing to go here and there. And to go to the main Taluk office etc.

                Any advise ?

                  My mom did not study upto 10th so no school certificate or any other certificate. Is a notarized affidavit from my MOM stating full name, birth date etc. sufficient ?
