  • I-485 delay or something? Please help!!!

I had I-140 approved, and applied for I-485, getting receipt on August 13, 2007, then received medical exam request in last April. I have sent out my medical exam, and my status at USCIS was updated as request for evidence received on April 23, 2009. The message also mentioned that I should receive a decision in 60 days unless I need to fingerprint or interview. It has been 6 months from that, however, I have not received anything, nor any update on USCIS for my case. I had
fingerprint long time ago (about 2 years ago). Do I need to fingerprint again or not. How long will it take to get the decision? Is there anyone has the same time frame as me getting any progress? Should I keep waiting or do anything else?

    Please give your advice.

    Thanks,
    Phong

Same kind of case, my received notice date is 16th aug 2007.

They asked for 2nd finger print. and ask for more evidence.

when they received noticed is "we received your response to our request for evidence. This case is being processed at our NEBRASKA SERVICE CENTER location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283."

What kind of evidence did they ask for?

I am just curious about how far my status is and why it take too long from my medical exam, and considering if I should contact them. Could you tell me a little bit more about your case? When did you do the 2sd fingerprint? What kind of evidences did they ask for? And when did they ask for that? Did you do medical exam? And when did you do that?

If you like, you could call them and ask them, i do not think that would be problem.

i did medical exam on some time in august 2007, and we sent medical report with all application package.

my case is EB3. applied on 2007 Aug..i did 2nd finger print just 4 month before. 1st finger print was after i send the I-485 application.

They asked for Affidavit of birth, current address...and new 325A form...

they asked all docs 3.5 month before. we sent little over then 2 months,

so we have this message on our status..
"we received your response to our request for evidence. This case is being processed at our NEBRASKA SERVICE CENTER location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. . I will let you know if I got it too.

                zenith,

                I believe you some confusion.

Visa bulletin specifies how long you have to wait before you file I-485 or apply for immigrant visa.

After you file I-485, USCIS processing times indicate how long they will take to approve your case.

Therefore, those two timings are different.

When you say "USCIS processing times indicate how long they will take to approve your case" what does it mean with regards to (October 26, 2007) date they posted on their website? Are they working on applications prior to that date?

Thank you for taking time answering my question.

my fiance is in same state as Mr.Phong

My fiance is in same status as Mr.Phong.He had filed his I-485 petition 2 yrs back and got the receipt. Then they asked him for medical examination proofs which he had sent. And it is in same state since July 2009.

when they received noticed is "we received your response to our request for evidence on July 2009. This case is being processed at our TEXAS SERVICE CENTER location......"

He gave his fingerprints 2 yrs back. They should be calling him soon for the second print. Can I file my I-485 petition as his derivative after he gets the fingerting call letter? Also please tell me if it is possible to postpone the fingerprinting interview date? Please respond ASAP.
