  • Pls members I need guidance!!!

    I came to the United States as a student since last year October. I am now 24 years and I met this lady 5 months ago, we decided to get married now but the following are my problems:

    1.) I have a brother who just his 2 years green card less than a month ago and I want to use him as my Sponsor. Is it advisable to do that?

    2.) I am out of status now, Will they ask me the reason why I'm out of status because I didnt attend the school for a day. What can I say?

    3.) Will I need an Attorney? and if we do the marriage, like when is it advisable to file for my AOS?.

    I will really appreciate any advice.

    1) If you bro is a GC holder he cannot sponsor you ( file for your greencard).

    2) Is your wife/fiance a US citizen, then your status may not be too much of an issue, other wise you will be SOL.

    3) Given your many missteps, it may be advisable to seek an attorneys guidance. Getting an approved I-130 precedes filing for AOS.

      My fiancee is a US citizen.
