    I would really appreciate some help on this issue....

    a brief background...

    I came here on a F-1 visa, which expired in August 2007. I married an American (born in US citizen) Jan of 2007 without my parents consent....I didn't adjust my status and am starting the process now.....if you are wondering why, its because it was a battle convincing both our parents and I was so mentally drained, I didn't do it....(stupid...i know!!)

    Anyway, fast forward to 2009, both sets of parents have agreed are relaxed and have changed 360 degrees....so I'm in a better frame of mind and am looking forward to adjusting my status (I-485), getting a job etc....

    Problem 1: I just checked my passport and noticed it expired 14 months ago.......so my dilema is, when I send the passport to Indian consulate...it shows an expired visa & now a freaking expired passport....should I send a copy of marriage certificate and a letter from my attorney who will be working on adjusting my status? Should I also include a letter explaining the circumstances leading to the delay in adjusting my status.

    What can I do or send it make it smoother on renewing my passport??

    Your expired visa or your AOS process has nothing to do with renewing your passport by your embassy. But at the same time, one must maintain a valid passport in foreign countries regardless of expired visa or not. During the AOS interview, they might ask you the reason for having a gap in between your expired passport and a new one, but it doesn't happen that often. You can do your medical, bio or even interview on your expired passport. You are out of status, with an expired passport, so there are risks involved, like getting arrested by ICE and getting a NTA. My suggestion, if you make one mistake, do not keep on making more mistakes to a point where it gets too complicated that you end up having a very rocky ride. But even having a green card, you still need a valid passport to travel out of USA.Your attorney should have told you about that. If you have an attorney and you are asking very basic questions, then my advice, change your attorney and get a more competent one.At this point in your life, where AOS is more important to you, saving few dollars in this process should not be your number one priority. Just follow the instructions by the embassy on renewing the expired passport. You can also call them as well.
