first time we came to USA was 1999, husband had H2b visa.
after year and a halve, we went back to Europe.
September 2001 came back on new H2b visa, new job , expired on september 2002
August 2002 lawyer asked for extention, got receipt ' notice of action"
filled 31 august 2007 , amount recieved $130,-
got requests for more evidence , denail notice, reopened the case, ect.
in October 2003 went back to Europe because lawyer told us there was no hope, with this employer. (extension case was finally closed in 2004)
Filled new request for H2b with new employer, January 2004 , got H2b , came back to USA.
Started procedings for I-485 ( 2003 ) got all done and filled 4 November 2004
we where aloud to stay, but not to work .
( lived of our savings and in our friends basement for almost 6 months)
April 2005 we both got work authorization cards and travel documents, we have been renewing every year and got them every year.
over the years we did:
finger printing every year, did our physicals ............
now our "denail notice"
based on that our extension in 2002 was filled to late, so we where here illegal in 2002, there saying.
we send there " notice of action " ( filling date august 2002) but there saying
there files are different ?????
In the period 1999 till 2009 , we have been thru so many obstacles, and now this.
so now the lawyer filled " motion to reopen"
I asked a second opinion with other lawyer, he told me , there is noting he could do different. He told me, if they do not reopen , we need to leave and we will be banned for 10 years.
Does anybody has, any experians with this ????
Do we need to start pakking ?
sell our house and cars , close our pension plans, let my husband quit his job, close my bussiness ......
in our eyes , we have never been here illigal, we did everything with a highly recommended immigration lawyer, I do not know what to do , I am really desperate ....
please advise ???
