  • regarding AOS timeframe

Hi guys.I'm new in the site.Just want to ask some question regarding Adjustment of Status. I got here in US:

    Date of Entry: Oct.8,2008
    Married : Oct. 11,2008

We wanted to file AOS as soon as posible but due to economic crisis, my husband is one of those people who got laid off from work after 2 months we got married. He got new job after four months then got laid off again. In short financially we aren't able to file.My question is : Is there any time frame to apply AOS? We are married for a year now, does anyone have the same situation as we do? Thank you very much I do appreciate some response. God bless

Is your husband a US citizen or Perm Resident?

Whoa, simmer down. I needed that information prior to answering the question I asked, so dont be impatient . Now, if he is a USC as you say he is, it is unlikely you will deported. You NEED to do a lot of research on the process of adjusting your status after you have overstayed at the USCIS website as well as on this forum. There is a lot of information you can find here if you take the time to search. Sorry I dont have a yes or no answer for you but you should be fine. You will have to pay a fine for the overstaying.

        All the best.
