    What are my options if I get laid before 180 days has passed since my 1485 application.

    1. How long can I stay in the US?
    2. Should I get on to a F1 or other visa as I am also running out of my H1-B - 6 years in June

    My only concern is that I may not have enough time to sell my house & other belongings if I have to leave in 10 days once my H1 expires.

    Please share your experiences.

    Not Legal Advice:

    Find another job using your EAD.

    The actual law says that you do not have to be working for your sponsering employer to get your green card as long as the I485 "remains unadjuducated for more than 180 days".

    In other word as long as the INS takes longer than 180 days to adjudicate the application you should be free and clear, irrespective of when you stopped working for your previous employer.

    You should however CONSULT WITH A KNOWLEDGABLE ATTORNEY and get sound advice. There are no regulations from the INS as yet to put this all in concrete terms but from what I understand, from reading the web pages of various lawyers, you may still be OK.
