    Hi everyone,

    I've been browsing through this forum and found many interesting and helpful suggestions on filling-out the I-130, I-131, I-485, G-325, I-765 Forms.

    This is my situation.
    I am a U.S. citizen and I just got married to a Japanese citizen who was originally in the U.S. on a student VISA and, now that she graduated from college, shes in the U.S. on an OPT VISA.
    We were married in NY/NY and a marriage certificate was issued right after the ceremony.

    I'm trying to file papers with USCIS for my wife. Here are some of my questions and concerns.

    1. In the I-485 instructions, my wife needs to submit evidence of her criminal history. Does she need to submit any evidence if she does not have a criminal history (i.e., shes has never been arrested nor performed any unlawful acts in the U.S. or Japan)?

    4. In the I-485 instructions, my wife needs to submit a medical examination report. Does this form need to be filed concurrently with the I-130 and I-485 form?

    5. My wife's OPT VISA will expire on July 16, 2010. If her OPT VISA expires while her I-130 and I-485 applications are pending before USCIS, will the U.S. require her to go back to Japan until her I-130 and I-485 applications are approved?

    6. We would like to go on a honeymoon during September 2010, does she need to apply for an I-131 form for advance parole?


    Please help because I would like to save $4,500 worth of legal fees.

      Sorry, but I've read through the link that you provided but I still have some of the same questions I stated in my earlier post.

      Can someone please help me fill-out these ambiguous forms. Thanks.

        Everything is on that link I'm not sure why u still have more questions,,,

        1- well if there is no criminal hist so there is no evidence to send.

        2-Medical exam u can send it with or without it, it's always good when u send everything together that way u will not get RFE.

        3-when u send I-130 and I-485 together that gives u legal status until the I-485 approved or denied so she won't have to go to Japan.

        4-yes you need AP to travel and if u send all the forms and all documents u should get green card way b4 sept 2010.
