    Hi
    I submitted the applications few weeks ago and they are rejected and returned to me due to the incorrect fee.

    1) Can I resubmit the returned forms (without printing new applications) with correct check amounts?

    2) I have H1B visa stamp valid up to next June 2010. I need to travel overseas this week for a wedding. I want to submit my application ASAP as I dont want any further delay.
    a) Is it advisable for me to resubmit them first before traveling?
    b) If I travel, I will get new I-94#. Then the i-94# provided on the forms will not be updated, will it be a problem.

    Re submission of forms 485/130.

    Hello, beautifulroselilly. you do not have to submit a new form, just include the appropriate money and send back the old form, because if you refill a new form a million times without the correct fees they will keep rejecting it. The Service is more interested in your money than who you are. Its money first then every other things shall be added.

        If it urgent that you travel, I will advice that you do that with your HIb visa, and get a new 1-94 on your return, but if it is imperative that you submit your I 485 form, then my advice would be that you do that with an advance parole( travel with I-131), otherwise your application may be deemed abandoned and this may possed a problem for you in re-entry. Most importantly the hib visa is a non-immigrant visa and by traveling out with a pending immigrant visa application, you have clearly shown your intention to stay put in the US. USCIS/DOS, will frown at this, it is a case of an ostrich buring it's head in the sand, thinking no one can see him. What I am saying is if it's a matter of life and death, travel on your hib and on your return put in your I-485, application then you wouldn't need to file for I-131/ADVANCE PAROLE. IF not be careful of the owl.
