    Dear Members,

    It is great to see you all helping each other with your advice. I have some questions and appreciate your response.

    1.Right now I am on H1B, my I-485 was filed in Aug 2007 under EB3. My current employer would like for me work part time and move on to EAD in another couple months. Once on EAD, I'll want to work for another company as a secondary job. I have this offer already but I don't know if I can work for the new company while still working with my current employer part time on EAD. My current employer who filed for my GC is willing to help me with all my immigration process.

    2. And as I will only work for the current employer (who filed for my GC) on part time basis some times, I may never get any hours and they may not run pay roll or if they run it will be less than my current pay roll. So my question is on EAD, is it OK to get the pay roll run for less amount and will it pose any problems if I use EAD while not getting paid by the employer who filed the GC?

    3. I read somewhere that after you file for AOS, you do not need to be in the country as the AOS is pursuant to future employment also and so I can be out of the country and can come back during the AOS approval. Is this true?

    Any help is very much appreciated.

      1. Your GC sponsor employer must agree to pay the proferred wages upon approval of the GC and have a full time position for 40 hrs available to you at that time without which the GC filing is considered fraudulent. As an alternative, you can find a same/similar job and file AC21. Read about it. But you can work for any number of employers on EAD provided these conditions are met.
      2.No issues as long as #1 is true.
      3. AOS is for being in the country. If you don't want to be in the country, CP is the way to go.

        My employer should not have a problem to pay the wages upon approval of the GC. I don't want to do the AC21 and leave my current employer. He has helped me over 5 years during my time with him.

        It is just that the company is going through some financial times and they are willing to help me through the process as long as I am not an extra wheel to them.

          If they are going through the finiancial times, how can they sponsor your future employment petition? Don't get involved in any likely cases of fraud by any means. I see ability to pay issues right out of the post.
